Introduction

OÜ Berlin-Chemie Menarini Estonia (“Company”) takes the user's privacy very seriously and commits to respect it to the best of its ability. When you visit the website www.berlin-chemie.ee (“Website” or “Site”) or request the services available on the Site, the Company may process your personal data. The current Privacy Policy (“Privacy Policy”) outlines the activities performed by the Company in the processing of your personal data through its Website and the commitments undertaken by the Company in that respect.

Wherever established by the Estonian Personal Data Protection Act dated 15 February 2007 (“Privacy Law”), your consent will be previously requested to process your personal data.

Where you provide personal data of third parties, you must undertake previous actions to ensure that the disclosure of such data to the Company (and the subsequent processing for the purposes specified in the applicable privacy information notice) is compliant with the Privacy Law, as well as with the applicable laws and regulations: by way of example, you may provide personal data of third parties only after having duly informed them and upon receiving their specific consent.

Type of Data Processed

Visiting or consulting the Website does not usually entail the collection and processing of your personal data, except for “navigation data” and cookies, as detailed below. In addition, you might voluntarily provide personal data to the Company either when you interact with some functions of the Website or when you require certain services available on the Site.

Navigation Data and Cookies

Processing of your personal data on the Website is limited to the so-called “navigation data”, that is the data transmitted to the Website as necessary for operating the computerised systems set up for managing the Website as well as the Internet communication protocols. By way of example, the IP addresses or the domain names of the computer used to visit the Website, as well as other parameters relating to the operating system used to connect to the Website. The Company collects such and other data (such as the number of visits and the time spent on the Website) for truly statistical purposes and in an anonymous manner in order to monitor the functioning of the Website and to improve its efficiency. Such data are not collected to be associated with other information regarding the users of the Site neither to enable your identification; yet, due to the nature of such data, information could allow your identification through processing and association with other data held by third parties. For such reason, navigation data are immediately de-identified after processing and could only be retrieved by the Company to ascertain liabilities concerning computer offenses committed to the detriment of the Website or through the Website. Notwithstanding the above, navigation data as described above are only kept for a limited time in compliance with the applicable regulations.

The Site uses “cookies”. By using the Site, you agree to the use of cookies as described in this Privacy Policy.

Cookies are small files saved on the hard disk. The Site uses so-called “session cookies” and “persistent cookies”.

Session cookies are temporary strings of information that are used in order to facilitate the use of the Site, for internal security purposes and administration of the system. The cookies used on the Site do not contain information on the users; such cookies are saved in a temporary mode and are immediately deleted right after you close your browser.

Persistent cookies may have a variable duration (from one hour to one year). The Company adopts this type of cookies only to save the language selected by the user and to send statistical information to the Google Analytics system, which allows the Company to analyse the accesses/visits to the Website for statistical purposes. The cookies are adopted for purely statistical purposes and the information thereof is collected in aggregate form. The Company does neither access nor control the cookies, web beacons and other tracking technologies used on third-party websites which you might access from the Website; the Company does neither access nor control the contents or the documents that are published on or are obtained through said websites; the Company does neither access nor control the method of processing of your personal data, for which the Company expressly declines any liability. You shall check the Privacy Policies of the third-party websites you access from the Site in order to know the terms that apply to the processing of your personal data. It is understood that the current Privacy Policy only applies to the Website as defined above.

Retention and Storage of Personal Data

Personal data are retained and processed by computerised systems that belong to the Company and are managed either by the Company or by third-party suppliers of technical services; for more detail please refer to section “Data Access” further below. Data are only processed by highly qualified personnel, including the personnel appointed to carry out extraordinary maintenance operations.

Purposes and Methods of Data Processing

The Company may process your personal data for the following purposes: management of your communications (including notification of pharmacovigilance events), management of your requests for information, etc.

Your personal data are processed both in paper and in electronic form in compliance with the Privacy Law and according to profiles of data security and confidentiality, in line with the principles of fair and legal data processing.

Data are retained for the time strictly necessary to achieve the specific purpose for which they were collected.

Safety and Quality of Personal Data

The Company undertakes to protect the security of your personal data and to fulfill the safety provisions as established by the Privacy Law and by any applicable regulations in order to prevent loss of data, illegal or illicit use of the data and unauthorised access to said data.

The Company has adopted appropriate technical measures such as multiple advanced safety technologies and procedures to protect data against alteration, loss and unauthorised access: as a matter of fact, your personal data are retained on servers located in rooms with restricted access and subject to controls. In addition to that, the information systems and computer programs used by the Company are set up in a way to minimise the use of personal and/or identification data. Data are processed to the strictest necessary extent and only in order to achieve the specific purpose of their collection. You can help the Company to update and/or to ensure the correctness of your personal data by communicating us any information regarding your address, qualifications, contact details, etc.

Data Access

Your personal data will be accessible only to the personnel in charge of data processing within the Company. In relation to their duties, such personnel may need to process such data to manage your requests. Data may be disclosed to other employees of the Company as well as of the other companies of the Menarini Group, including A. Menarini Industrie Farmaceutiche Riunite Srl, for the same purposes as stated above and/or for administrative purposes.

Without prejudice for the provisions of the above paragraph, your personal data will not be communicated to third parties, be it natural or legal persons, and they will not be disseminated in any other manner or form.

Provision of Personal Data

Where marked by an asterisk [*] your data are necessary for the Company to process the enquiries received through the Site (e.g. requests for information and/or material) or to contact you to follow up your requests. Your refusal to provide such data will prevent the Company from providing the services you have requested. Provision of any other data not marked by the asterisk is optional: your refusal will not determine any actual implication.

Exercising Your Rights

You may at any times exercise the rights established by the Privacy Law, including the right to receive confirmation of the existence of your personal data within the Company, the right to check the content, the source and the accuracy of your data, and/or to request that your data are updated, erased and/or de-identified, if unlawfully processed, as well as the right to stop the processing of such data for any legitimate reasons.

Google Tag Manager

Google Tag Manager is used on this website. Google Tag Manager is a Google Inc. solution for companies to manage their website tags via an interface. The Google Tag Manager tool does not use cookies and does not collect personal data. The tool provides for the initiation of other tags that, in turn, might collect data. Google Tag Manager does not access these data. If a deactivation was made on the domain or cookies level, this remains in place for all tracking tags implemented by Google Tag Manager.

Google Maps

We use the services offered by Google Maps on this website. This makes it possible for us to display interactive maps for you directly on the website and gives you comfortable to access the map function. This is done on the legal basis of Article 6 (1) (f) GDPR.

It is necessary to save your IP address to use the Google Maps functions. When you visit the website, Google receives the information that you have called up the relevant sub-page of our website. This occurs regardless of whether Google provides a user account via which you logged in or whether there is no user account. If you have logged in via Google, the data will be directly linked to your account. If you do not want the data to be linked to your Google profile, you must log out before activating the button. Google saves your data as a user profile and uses them for advertising purposes, market research and/or the demand-based design of its website. You have a right to object to the creation of such a user profile; to exercise this right, you must address your objection directly to Google.
